To understand, even in an introductory manner, the way the Judiciary operates in the contemporary State, it is necessary to examine the historical succession of the State’s political organization models. In this analysis, it is observed that judicial action changes according to the alterations undergone by the state entity, and it is certain that, in a Democratic Rule of Law, the figure of the judge assumes the role of enforcer of fundamental rights, even if they must occasionally act in the realm of controlling the activities performed by the other branches of government.
