Abstract

This paper analyses the Non-Prosecution Agreement (ANPP) in crimes committed by legal entities, covering their particularities in relation to individuals. Thereby, based on the deductive method, a brief history of the ANPP in the Brazilian legal system was presented. It also addresses the objective and subjective requirements listed in art. 28-A of the Criminal Procedure Code, and the conditions that are to be imposed for the investigated. Furthermore, the issue that involves criminal liability of legal entities was approached, and at the end, with the information collected in the previous topics, this paper brings a discussion about the applicability of the ANPP to collective entities. Based on the
bibliographic material that was presented, it was verified that there is no incompatibility between the institute and legal entities.
