Abstract

This study deals with police power and fundamental rights in exceptional situations. The aim is to demonstrate the legality of administrative measures regarding fundamental rights. A historical analysis of police power, its characteristics and limitations is presented. The role of the Democratic State of Law in exception regimes is discussed, with specificity in relation to the right to come and go. The research uses the deductive method, with investigation in books, articles and analysis of legislation.
