Abstract

This article seeks to demonstrate the possibility of compulsory treatment according to the measures provided in Law 13.979/2020, edited to control the Coronavirus. For this purpose, an analysis is carried out on the possibility of weighing up the fundamental rights of health and freedom of movement at exceptional times and how the Public Adminstration makes use of police power. Finally, Law 13.979/2020 is analyzed, focusing on its art. 3º, which makes it possible to adopt compulsory treatment as a measure to combat Covid-19. The deductive method is used, with bibliographic research in books and articles, in addition to legislation on the subject.
