Alimony in the prenuptial agreement: brief comments

The article introduces the possibility of setting up an alimony clause in the prenuptial agreement, for spouses and their children whether there is a divorce. The debate focuses the controversies surrounding the theme, such as waiver of alimony, quantum of pension, whether it is a patrimonial or extra-patrimonial subject, all with the point of the view of doctrine. It points out, moreover, the question of the essential analysis of alimony binomial about the possibility of payer, in face of his future and obligee. Finally, faces the discussion on the implementation and effectiveness of the alimonyclause laid down in the marriage contract, all under the doctrine and jurisprudence positions’.
